OOFlora Terms of Use and Privacy Policy

This document has two parts: the Terms of Use and the Privacy Policy. It corresponds to Terms & Privacy in the App’s Settings. Please read it before using the App. By downloading, installing, opening, or continuing to use the App, you agree to this document. If you do not agree, please stop using the App and uninstall it.

The App’s interface is available in Simplified Chinese, Traditional Chinese, and English. This English version is written for users outside mainland China and is intended to align with commonly applicable rules such as the GDPR / UK GDPR, the California Consumer Privacy Act (as amended by the CPRA), and the U.S. Children’s Online Privacy Protection Act (COPPA). Users in mainland China should switch to the Chinese version.

Part I — Terms of Use

1. Parties and scope

1.1 These Terms are an agreement between you and the operator of the OOFlora application (the “App”) (“we”, “us”). You and we both acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and the content thereof.

1.2 The App is a personal, on-device creative and casual tool. The current version does not require an account or sign-in, and does not upload your content to servers operated by us.

1.3 The interface language you choose does not change which version of this document applies. For users outside mainland China, this English version controls.

1.4 Relationship with Apple. If you obtained the App from the App Store: we, not Apple, are solely responsible for providing any maintenance and support; Apple has no obligation to furnish maintenance or support. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. We, not Apple, are responsible for addressing claims relating to the App or your possession and use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or privacy law. In the event of a third-party claim that the App or your possession and use of it infringes intellectual-property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance Apple will have the right to enforce these Terms against you as a third-party beneficiary.

2. What the App provides

Features available in the current version include the following (the version on your device controls):

2.1 Shoot your own flower
You may take a photo with the camera or pick one from your library, then crop, apply filters, and choose petal and flower-core styles on your device to create a custom flower.

2.2 Those Flowers
Save custom flowers (including Chinese and English names, serial numbers, back notes, and favorites), browse the system flower catalog and today’s flower language, save cover photos for system flowers, and review what you have captured and saved.

2.3 This month’s records
Stamp cards are organized by date so you can look back month by month.

2.4 Floromancy
A petal-picking game to help with small decisions. You may record or replace short voice clips (two sides), and adjust flower sources, flower count, and background music. Results are for entertainment only and are not advice, promises, or professional opinions.

2.5 Oops
A casual multiplayer petal-picking game using built-in animal characters and life points. Results are for entertainment only.

2.6 Flowers & Time
A timer accompanied by flowers and background music, with a duration you choose.

2.7 Achievements and stickers
Completing certain actions in the App may unlock achievement stickers and let you generate a share image. Some achievements also unlock notebook-cover appearance options for today’s flower language.

2.8 Settings and other items
Including appearance (notebook cover), a vibration toggle, interface language, optional iCloud backup and restore; Feedback (opens the App Store write-a-review page); Contact & Support (opens the system mail composer); Version Update (opens this App’s App Store product page); and Other Apps (opens another product page on the App Store).

We may add, change, pause, or discontinue features. We will try to explain material changes through App updates, but we are not obliged to compensate you for such changes.

3. Acceptable use

3.1 The App does not set a minimum age to download or use it. It is a casual creative tool: no social feed, no public posting, no in-app ads, and no sexual or violent content. Minors are welcome. The App Store age rating is declared separately when we submit the App and is meant to reflect a light, general-audience experience.

Camera and microphone are optional. If a minor uses them, we recommend a parent or guardian be aware. Ages such as 13 (COPPA in the United States) or the digital-consent age where you live are not an access barrier for this App. They only mean that, if personal data of a child is processed (for example photos or voice clips stored on the device), a parent or guardian should read the privacy parts of this document and agree on the child’s behalf. Browsing the catalog, using the timer, and playing with built-in flowers do not require providing personal information.

3.2 You agree to use the App lawfully and in good faith, and not to:

• violate applicable law, public order, or other people’s rights;
• capture, record, save, or share photos, audio, names, or notes that are unlawful, infringing, pornographic, violent, discriminatory, harassing, or otherwise inappropriate;
• photograph, record, or process another person’s likeness, voice, or other personal information without a lawful basis (including their consent where required);
• reverse engineer, decompile, crack, or tamper with the App, or interfere with its normal operation;
• use the App for fraud, harassment, or anything that may harm us or others.

We have a zero-tolerance policy for unlawful, infringing, or objectionable content, and for abusive use of the App. The App does not host, publish, or display your content to other users. Anything you send through the system share sheet goes to a destination you choose and is not posted inside the App. To report misuse, contact us via Settings → Contact & Support; we will review reports promptly. Because the App runs on your device, we cannot remotely delete content that exists only on that device. If a violation is confirmed, we may refuse further support and take other steps permitted by law.

3.3 Camera, microphone, and photo-library access are used only for the features described in the App, and only after you grant permission. You may revoke permission in iOS Settings at any time. Related features may then stop working; other features that do not need that permission remain available.

3.4 Floromancy, Oops, and similar play are random and recreational. Outcomes are for fun and do not replace your own judgment.

4. Your content

4.1 “Your content” includes, without limitation: photos you take or pick, generated flowers and stamp cards, flower names, notes, Floromancy voice clips, favorites and achievement progress, and anything you send through the system share sheet.

4.2 You retain the rights you have in your content and warrant that you are entitled to provide it. You are responsible for disputes or liability arising from your content.

4.3 We process your content only on your device and, if you turn on iCloud backup, in your own Apple iCloud account, so we can provide save, display, gameplay, backup, and sharing features. We do not use your content for advertising targeting and we do not sell it.

4.4 You may delete custom flowers, notes, photos, recordings, and similar items in the App. Uninstalling the App deletes data stored on the device. If you enabled iCloud backup, cloud copies are managed by you through the App’s backup/restore controls or your Apple account.

4.5 If you use system sharing or “Save to Photos”, the content is delivered to the Photos library or third-party app you choose. Later use of that content is governed by those systems or third parties, which we do not control.

5. Intellectual property

5.1 The App’s software, interface, illustrations, flower assets, music, copy, marks, and layout belong to us or the rightful owners, except for your content and material that lawfully belongs to third parties.

5.2 You may not copy, distribute, rent, lend, modify, or commercially exploit the App’s software, assets, or branding without our written permission.

5.3 You keep ownership of content you create in the App. You grant us a limited, non-exclusive license to process that content only on your device and in your own iCloud backup, solely to provide the App’s features. That license ends when you delete the content or stop using the App (except for copies you already shared with third parties at your direction).

6. Disclaimers

6.1 The App is provided “as is”. We take reasonable care to keep it working, but we do not warrant that it will be uninterrupted, error-free, or fit for a particular purpose.

6.2 To the extent permitted by law, we are not liable for data loss, unavailable features, or a degraded experience caused by device failure, revoked system permissions, insufficient storage, operating-system or iCloud issues, your deleting or overwriting data, jailbroken or unofficial installs, or events beyond our reasonable control.

6.3 Please back up anything important. iCloud backup can reduce the risk of loss after a new device or reinstall, but iCloud is provided by Apple; availability, storage location, and security follow Apple’s terms and policies.

6.4 To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of, or inability to use, the App. Nothing in these Terms limits liability or consumer rights that cannot be limited under the mandatory laws of your country or region of residence, including as they apply in the EEA, the United Kingdom, and similar jurisdictions.

7. Changes and termination

7.1 We may revise these Terms because of new features or legal changes. The updated text will be published in the App or on a related page, with a new effective date. If a change is material, we will give appropriate notice. Continued use means you accept the revised Terms.

7.2 If you breach these Terms (including section 3.2), we may refuse further support and take other steps permitted by law. You may stop using the App and uninstall it at any time.

8. Governing law and disputes

These Terms are governed by the laws of the country or region where you ordinarily reside, excluding conflict-of-law rules, and without prejudice to mandatory consumer-protection rights you have there. Please try to resolve disputes with us amicably first. If that fails, you may bring a claim in the courts of competent jurisdiction in your country or region of residence, unless mandatory law requires otherwise.

If you live in the EEA or the United Kingdom, you may also use any alternative dispute-resolution or small-claims procedure available to consumers where you live.

Part II — Privacy Policy

We care about your privacy. This policy explains how the App collects, uses, stores, and protects information.

The current version of the App has no accounts, does not run advertising tracking, and does not upload your content to servers we operate. The App’s Apple privacy manifest also states that we do not engage in Tracking and that we do not collect the data types Apple requires us to declare as collected by us.

You can browse the catalog, use the timer, and play the built-in games without providing a name, phone number, or other registration details. Camera, microphone, Photos, and iCloud backup are optional and are used only after you grant permission or turn them on.

If you are in the European Economic Area, the United Kingdom, or a similar jurisdiction, the operator of the App is the controller of personal data processed to provide the App. Much of that processing happens only on your device; we do not receive a copy on our own servers.

1. Principles

• Minimum necessary. We process only what the features need.
• On-device first. Photo editing, petal compositing, filters, games, and the timer run on your device.
• Your choice. Camera, microphone, Photos, and iCloud backup require your permission or an explicit toggle.
• No sale, no ad profiling. We do not sell your personal information and do not use it for third-party advertising.

2. Information we process

2.1 Content you create or provide

This is your content. If it includes a recognizable image or voice of a person, it may be personal data. The App does not run face recognition, voice biometrics, or identity checks; it uses this content only for the local creative and entertainment features you choose. We do not use it to train models, serve ads, or show it to other users unless you yourself send it through system sharing.

2.2 On-device preferences and state

To remember how you use the App, we store items locally (UserDefaults and the App sandbox), for example:

• whether you finished first-run onboarding;
• vibration, interface language, and notebook-cover appearance;
• last camera filter, petal style, flower-core style, and shutter-sound preference;
• Floromancy / Oops / Flowers & Time settings (flower sources, flower count or life points, background music, timer duration and volume);
• achievement unlock state;
• whether iCloud auto-backup is on, and status about the last backup.

These values are used only to restore your settings in this App. They are not used to recognize you in other apps.

2.3 Backup metadata (only if you use iCloud backup)

If you turn backup on, the backup package may include backup time, app version, device host name, and counts of custom flowers, monthly records, and system-flower photos. This is used to check integrity and show backup status. It is stored in your iCloud account, not on our servers.

2.4 Limited system APIs

To power features, the App may call the following system APIs on your device (also declared in the Apple privacy manifest). They are not used to track you or the device across apps:

• System boot time — to measure intervals for timing features such as Flowers & Time;
• File timestamps — to see whether files in the App sandbox have changed, so we can decide whether to run an iCloud backup;
• UserDefaults — to store the preferences in section 2.2.

2.5 What we do not collect

In the current version we do not ask for or collect:

• registration details such as name, phone number, email, or government ID (there is no sign-up; Contact & Support only sends mail if you choose to write to the address published in the App);
• precise or coarse location;
• contacts, calendar, health, fitness, or financial data;
• IDFA or other identifiers used for cross-app tracking;
• your activity in other apps or websites.

The App currently includes no analytics SDK, crash-reporting SDK, or ads SDK, and has no in-app purchases or subscriptions.

3. Device permissions

The App may request the permissions below. Refusing a permission does not block features that do not need it. Granting a system prompt is your consent for the purpose described.

We do not request Contacts, Location, App Tracking Transparency, or push notifications for the current feature set.

Photo picking uses the system picker so we receive the single image you select, rather than your entire library.

4. Storage, backup, and transfer

4.1 On-device storage. Your content and preferences stay in the App sandbox (for example Application Support and Documents) and are accessible to this App on this device.

4.2 Optional iCloud backup (off by default). In Settings → iCloud Backup you may enable automatic backup or run a manual backup or restore. If enabled, when you send the App to the background we may sync the following to your own Apple iCloud account:

• custom flower assets and manifests;
• monthly records;
• system-flower cover photos;
• Floromancy voice files;
• preferences and backup metadata described in sections 2.2 and 2.3.

Cloud data is processed by Apple under Apple’s iCloud terms and privacy policy. We cannot sign in to your Apple ID and cannot view your backup on servers we operate.

4.3 Uninstall and new devices. Uninstalling the App clears on-device data. Without iCloud backup, that data usually cannot be recovered. On a new device, restore works only if you use the same Apple ID and successfully restore a backup.

4.4 International transfers. We do not operate servers that receive your content, so we do not ourselves send your personal information abroad. If you use iCloud, storage and sync follow Apple and the iCloud arrangements for your region. Where Apple transfers data as part of providing iCloud, that processing is governed by Apple’s terms and, where applicable, Apple’s transfer mechanisms (such as Standard Contractual Clauses).

5. Why we process information

We process the information above only to:

1. provide, maintain, and improve shooting flowers, the catalog, monthly records, Floromancy, Oops, Flowers & Time, achievement stickers, and appearance options;
2. remember language, vibration, appearance, game, and camera preferences;
3. back up and restore via iCloud when you ask;
4. save to Photos or invoke the system share sheet when you ask;
5. open the App Store (Feedback, Version Update, Other Apps) or the system mail composer (Contact & Support) when you ask;
6. comply with applicable law.

Legal bases (EEA/UK and similar laws). Where those laws apply, we rely on:

• your consent for camera, microphone, Photos, and optional iCloud backup (you may withdraw it by turning off the relevant iOS permission or the iCloud backup switch);
• performance of the contract — providing the on-device service you requested — for local preferences, sandbox files, and timing / file-timestamp APIs;
• where needed, legitimate interests in running a stable on-device app, balanced against your rights.

We do not use your information for marketing automation, profiling for ads, or providing advertising to third parties. We do not make solely automated decisions that produce legal or similarly significant effects.

6. Sharing, sale, and disclosure

6.1 We do not sell your personal information (including as “sale” or “share” are defined under California law). We do not share it for cross-context behavioral advertising. We do not use or disclose sensitive personal information for purposes that California law treats as requiring a “limit the use” right beyond what is needed to provide the App.

6.2 Others may process information only in these situations, which are not a bulk disclosure of a user list:

• Apple: iOS, the App Store, Camera / Photos / Microphone frameworks, iCloud document storage, the system share sheet, and system Mail follow Apple’s privacy policy. Tapping Feedback, Version Update, or Other Apps opens the App Store;
• Destinations you choose: when you share a flower or sticker, the content goes to the app or person you pick;
• Mail you send: if you use Contact & Support, the contents of your message go to the published support address;
• Legal requirements: where required by law, legal process, or a competent authority.

6.3 Third-party libraries used in the App (for example Lottie, for on-device animation and sticker rasterization) run locally and do not collect your personal information for us.

6.4 If we later add a third party that processes personal information, we will update this policy and, where required, ask for your consent again.

7. Retention

• On-device content: until you delete the item, clear the App’s data, or uninstall;
• On-device preferences: until you change them, reset, or uninstall;
• iCloud backups: until you overwrite or delete the backup, or your Apple account data is removed under Apple’s rules.

After that, we stop using the information and delete or anonymize it, unless the law requires us to keep it.

8. Your rights

Depending on where you live (including the EEA, UK, and California), you may have rights to access, correct, delete, restrict, or port personal data, to withdraw consent, to object to certain processing, and — in California — to know, delete, and opt out of sale/share (we do not sell or share). You can exercise them in the App as follows:

• Access and use: view flowers, notes, photos, recordings, achievements, and settings in the App;
• Correction: edit names, notes, voices, game settings, appearance, and interface settings;
• Deletion: delete custom flowers, cover photos, recordings, and similar items (deleting a flower also removes linked monthly stamp cards);
• Withdraw consent: turn off Camera, Microphone, or Photos in iOS Settings; turn off iCloud auto-backup in the App;
• Copy / export (data portability, as far as the product allows): save images to Photos or send them via the system share sheet;
• Close the service: there is no account. Uninstall the App. To remove a cloud backup as well, manage the matching iCloud data under your Apple account.

If these controls are not enough, contact us via Settings → Contact & Support (system mail to ooflora@163.com). We will respond as required by applicable law and will not discriminate against you for exercising privacy rights. You may also lodge a complaint with your local data-protection authority (for example a supervisory authority in the EEA or the UK ICO).

We do not currently have a dedicated U.S. “Do Not Sell or Share My Personal Information” link because we do not sell or share personal information as those terms are defined under California law.

9. Security

We take reasonable steps to protect your information: storing content in the App sandbox, using system permission prompts for Camera / Photos / Microphone, not running our own content servers, and relying on Apple’s account and encryption mechanisms for iCloud.

No measure is perfect. Please keep your device and Apple ID secure, and avoid using the App on jailbroken devices or unofficial builds.

10. Children

10.1 The App is for a general audience and does not impose a minimum age to install or play. It has no online account, social feed, public posting, or in-app ads. We do not knowingly collect personal information from children in order to identify or contact them. The App is not directed at children as a COPPA “child-directed” service.

10.2 References to age 13 (or the digital-consent age where you live) come from children’s-privacy statutes. They are not a content rating and not a requirement that users be that old. They only apply if a child’s personal data is processed (typically photos or short voice clips the user chooses to create). Parents and guardians decide whether camera and microphone use is appropriate, and should avoid casually sharing images or recordings that identify a child or another person. Permissions can be turned off in iOS Settings; on-device or iCloud content can be deleted at any time.

10.3 If you believe a child has provided personal information in a way that is inconsistent with this policy, contact us via Settings → Contact & Support. We will help as we reasonably can. Content that lives only on the device or in your iCloud still needs to be deleted on the device or in the Apple account.

11. Changes to this policy

We may update this policy from time to time. The new version will appear at the same place in the App, with a new effective date. For material changes we will give reasonable notice in the App. If you do not agree, please stop using the App.

This document applies to the current iOS version of OOFlora for users outside mainland China. Users in mainland China should rely on the Chinese version.
